App Privacy Policy

This Privacy Policy explains how Gale Banks Engineering, Inc. (“Banks Power,” “we,” “us”) collects, uses, shares, retains, and deletes information in the Banks Power mobile app for iOS and Android (the “App”).

1. Scope of this policy

This policy governs the App specifically. Our website privacy policy continues to govern bankspower.com and our online store, and our Terms of Service govern your use of both. Where this policy and the website policy differ, this policy controls for information collected through the App.

2. Information we collect in the App

a. Account and contact information. The App requires an account. We collect your mobile phone number, which is your sign-in identifier and is verified by a one-time SMS code (or, on some Android devices, by a carrier-assisted verification that confirms the number on your device without sending a code). When you complete registration we also collect your first and last name, email address, and street address, city, state, and postal code.

b. Vehicle and module information. When you connect a Banks module over Bluetooth, we collect information about the module and the vehicle it is installed in: the module serial number, part number, hardware and firmware versions, and gauge or product type; the vehicle’s VIN; and the vehicle’s year, make, model, engine, displacement, and fuel type, along with engine controller identifiers and the calibration selections you make in the App.

c. Diagnostic, telemetry, and support information. We collect records of firmware update attempts (which module, which firmware versions, timing, and any error details) and, when you choose to send them, vehicle data logs you have recorded and bug reports. A bug report includes the subject and notes you write and the App’s own diagnostic log files for your current and previous session. Those log files describe what the App did — connections, commands, errors — and can include your account identifier, your VIN, and module serial numbers.

d. Device and usage information collected automatically. We collect a device identifier assigned to the App, your device brand and model, operating system and version, whether the device is physical or an emulator, the App’s version and build number, and counters describing how often and when the App is used. Google Analytics for Firebase, which is built into the App, also collects standard mobile analytics events.

We do not collect payment card numbers, government identifiers, contacts, calendar data, photos or videos, microphone audio, or health data through the App.

3. Bluetooth and location

The App uses Bluetooth Low Energy to find and communicate with your Banks module, including in the background so a session is not interrupted when you switch apps.

On Android, the operating system requires an app to hold location permission before it can scan for Bluetooth devices. The App requests that permission only for that reason. The App does not use GPS or any other positioning service, and it does not collect, store, or transmit your location. No latitude, longitude, or derived position is recorded in any file the App sends to us. Data logs may include a distance-travelled total computed from vehicle speed, but no coordinates and no route.

4. How we use your information

  • To operate the App: to sign you in, pair with your module, and keep your account and module associated with each other.
  • To deliver firmware and calibration: to determine which firmware and which vehicle-specific calibration or parameter sets apply to your module and vehicle, and to complete updates safely.
  • To provide customer support: to respond to bug reports and to analyze data logs you send us so we can answer your question or diagnose a problem.
  • For product reliability and improvement: to analyze firmware update successes and failures across devices, and to understand which parts of the App are used, so we can fix defects and improve the product.
  • To communicate with you about your account, your products, or a support matter you have opened.
  • For marketing by text message — only if you have separately opted in. See section 6.
  • To comply with law and to protect the security and integrity of our systems.

We do not use your information for automated decisions that produce legal or similarly significant effects about you.

5. When information leaves your device, and who receives it

Some information is sent automatically, and some only when you ask for it.

Sent automatically while you are signed in and connected to a module: your account profile, the module and vehicle information in section 2(b), App usage counters, and firmware update telemetry. This is what lets us match firmware and calibrations to your specific hardware and vehicle and support you later.

Sent only when you choose to send it: vehicle data logs (and, if you check the box to share the log with Banks Support, your name and email alongside it) and bug reports with their diagnostic logs. Data logs you record stay on your device unless you upload or share them.

Analytics are collected continuously while you use the App.

We share information with service providers who process it on our behalf under contract, and only for the purposes above:

We may also disclose information to comply with law or valid legal process, to enforce our Terms of Service, to protect the rights or safety of any person, or in connection with a merger, acquisition, or sale of assets — in which case we will require the recipient to honor this policy or notify you of any change.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

6. Text messages

If you check the box to receive product updates by text, you consent to receive recurring automated marketing text messages from Banks Power at the number you provided. Consent is not a condition of any purchase. Message and data rates may apply, message frequency varies, reply HELP for help, and reply STOP to cancel at any time. Opting out of marketing texts does not stop the one-time verification codes used to sign in, which are required to use the App.

7. How long we keep information

  • Account profile (name, email, address, phone number): until you delete your account, or until your account has been inactive long enough that we no longer need it.
  • Module, vehicle, and firmware records: retained for the life of the product relationship, because we use them for warranty support, firmware compatibility, and product-reliability analysis.
  • Uploaded data logs and bug reports: retained while the related support matter is open and for a reasonable period afterward for quality and engineering review; you can delete data logs you uploaded from within the App.
  • Diagnostic logs on your device: the App keeps only the current and previous session’s log, capped in size, and overwrites older ones automatically.
  • Analytics: retained according to the Google Analytics for Firebase retention settings for our project.

After a deletion request, we may retain a limited amount of information where we are permitted or required to — for security and fraud prevention, to resolve disputes, to enforce our agreements, or to meet a legal or regulatory obligation — and we will delete it when that purpose ends.

8. Deleting your account and your data

You can ask us to delete your Banks Power App account and the data associated with it at any time. There are two ways:

In the App. Open the menu, then Legal & Privacy → Delete account. You will be asked to confirm. This deletes your account and the associated data described below.

By email. Write to appsupport@bankspower.com from the email address on your account, or to the postal address in section 13, with the subject line “App account deletion” and the phone number your account uses. We will verify that the request comes from you before acting on it.

What deletion covers. Your account profile (name, email, address, phone number), your sign-in credentials, your module and vehicle records including VIN and serial numbers, your firmware update history, your uploaded data logs and the files themselves, and your submitted bug reports and their diagnostic logs.

What may remain. Aggregated or de-identified statistics that can no longer be associated with you, and the limited categories described at the end of section 7. Deleting your account does not withdraw your consent to marketing texts — reply STOP for that, or ask us in the same message. Data logs still stored only on your own device are removed by deleting them in the App or uninstalling it.

We complete verified deletion requests within 30 days.

9. Your privacy rights

Depending on where you live, you may have the right to know what personal information we hold about you, to receive a copy of it, to correct it, to have it deleted, to limit our use of sensitive personal information, and to opt out of sale or sharing (we do neither). Residents of California have these rights under the CCPA/CPRA; residents of the EEA and the United Kingdom have equivalent rights under the GDPR and UK GDPR, including the right to restrict or object to processing, to data portability, and to withdraw consent; residents of Canada have comparable rights under PIPEDA. Other U.S. states grant similar rights.

To exercise any of these rights, contact us using section 13. We will verify your identity before responding. We will not deny you products or services, charge you a different price, or give you a lesser quality of service because you exercised a privacy right. If we deny a request, you may ask us to reconsider by replying to our response. Where the GDPR applies, our lawful bases are performance of our contract with you (operating the App), your consent (marketing texts), and our legitimate interests (product reliability, security, and fraud prevention).

10. Children

The App is intended for users 18 years of age or older, consistent with our Terms of Service. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us at appsupport@bankspower.com and we will delete it.

11. How we protect information

Information sent between the App and our systems is encrypted in transit using TLS, and information stored in our Firebase project is encrypted at rest. Access to your records is scoped to your account identifier, and internal access is limited to personnel who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security; if you believe your account has been compromised, contact us immediately.

Your information is stored and processed in the United States. If you use the App from outside the United States, you understand that your information will be transferred there.

12. Changes to this policy

We may update this policy. When we do, we will change the “Last updated” date above and post the revised policy at this URL. If a change materially affects how we handle information already collected, we will provide additional notice — in the App or by email — before it takes effect. Your continued use of the App after a change takes effect means you accept the revised policy.
